D’s Lawncare Terms of Service
These terms are between you (“Client”) and D’s Lawncare (“Company”) and govern our respective rights and obligations.
D’s Lawncare is fully insured by Texas Farm Bureau.

Lawn Preparation
• Please remove toys, debris, and obstacles from the lawn prior to service.
• Pet Waste Policy:
Please ensure pet waste is picked up prior to service. Excessive pet waste will result in an additional charge.

Lawn Maintenance
Standard Service Includes:
• Mowing
• Edging
• Weed eating
• Blowing of all turf areas, sidewalks, driveways, and patios
Anything outside of standard service is considered a special service (when available).
Due to uncontrollable conditions such as weather and traffic delays, we cannot guarantee an exact service time and reserve the right to adjust scheduling.

Special Services Offered
Spring Clean-Up
Removal of leaves and winter debris from lawn and planting areas.
Pruning
Performed twice per year (mid-June and early September) to maintain plant health and appearance.
Mulch Installation
Improves appearance, retains moisture, and slows weed growth. Options include:
• Brown, red, black mulch
• Cedar mulch
• Shredded hardwood
Tree Trimming
Performed from ground level up to approximately 20 ft.
We are not a climbing/tree removal company.
Fall Clean-Ups (Oct–Dec)
• Leaf removal from beds
• Mulching or vacuuming leaves from lawn
Fence Repairs
• All repair sales are final
• No refunds or warranties on repairs

Fence Installation Terms
• 50% deposit required
• No warranty on pressure-treated materials
• 60-day labor warranty (cedar & chain link)
• 1-year warranty on cedar pickets only
• Storm damage is considered an Act of God (insurance claim required)
• Permits and 811 locates will be completed; all fees are billed to the client

Junk Removal / Evictions / Trash Outs
Junk Removal
• Priced per load (truck / trailer)
• Disposal fees added after service
Tenant Trash Outs / Evictions
• Priced per man-hour + disposal fees

Weed Control
• Non-flowering beds may be treated with herbicides
• Results may take 7–14 days
• Hand-pulling is an additional service

Yard Waste & Cleanup
• Yard waste is bagged during service
• Removal: $25 per service (up to 5 bags)
• Bags may be left at curb or placed per client request
Storm / Heavy Cleanup
• Not included in maintenance
• Must be scheduled separately
• Maintenance crews do not carry heavy equipment (chainsaws, etc.)

Scheduling & Requests
• Request additional services at least 48 hours in advance
• Some services are seasonal and may not be performed year-round

Invoicing & Payments
• Invoices sent same or next business day
• Credit card payments are subject to fees + sales tax
• Accepted: CashApp, Zelle, credit/debit

Limitation of Liability
General Liability
D’s Lawncare is not responsible for damage to property or items that are not clearly visible, marked, or disclosed prior to service.

Hidden or Obstructed Items
We are not liable for damage to:
• Sprinkler heads, irrigation lines, or valves not marked
• Underground utilities or wiring
• Landscape lighting, drainage systems, or invisible fencing
• Items hidden in grass (rocks, toys, tools, debris)

Pre-Existing Conditions
We are not responsible for:
• Weak, rotted, or improperly installed materials
• Loose fencing or unstable structures
• Existing lawn issues (bare spots, pests, fungus, disease)

Debris & Projectiles
Normal operations may cause debris to be displaced.
We are not responsible for:
• Broken windows or vehicle damage from debris
• Damage caused by failure to clear lawn of objects

Weather & Acts of God
We are not liable for:
• Storms, flooding, wind, or severe weather
• Fallen trees or natural disasters
• Any event beyond our control

Equipment Limitations
• Maintenance crews do not carry heavy-duty equipment
• Hazardous or large jobs must be scheduled separately

Chemical Applications
• May cause temporary discoloration or stress
• Results vary based on conditions
• We are not responsible for unidentified plants affected

Maximum Liability Cap
To the fullest extent permitted by law, D’s Lawncare’s total liability shall not exceed the amount paid for the specific service provided.

Indemnification
Client agrees to hold harmless D’s Lawncare from claims resulting from:
• Failure to disclose hazards
• Improper site preparation
• Third-party conditions beyond our control

Client Responsibilities
• Payment of agreed service rates
• Property must be accessible
• Pets must be secured

Gate Access
• Gates must be unlocked on service day
• Inaccessible areas will not be serviced
• Overgrowth may result in additional charges

Service Frequency & Cancellation
• Cancelling after first visit converts pricing to one-time rate
• $25 fee for late cancellations (after 5PM prior business day)
• $50 cancellation fee for special services

Damage & Complaint Policy
• Report issues within 24 hours
• Provide photos to: dslawncare254@gmail.com
• We will return to correct issues when applicable

Satisfaction Guarantee
If service is unsatisfactory, notify us within 24 hours and we will return to correct it at no additional cost (schedule permitting).

Declined Payments
• Cards retried once
• Service paused after second failure
• Accounts unpaid after 30 days → final notice
• After 15 days → sent to collections
• Chargebacks → sent to collections

SMS & Email Communication
By providing contact information, you consent to receive communications. You may opt out anytime.

Holiday Schedule
No service on:
• New Year’s Eve & Day
• Memorial Day
• Fourth of July
• Labor Day
• Thanksgiving & Black Friday
• Christmas Eve & Day
Service will resume next available day. Limited operations between Christmas and New Year’s.

FAQ (Summary)
Do you mow after rain?
If too wet, mowing may be skipped, but other services may still be completed.
Shrub trimming all at once?
May take multiple visits unless a cleanup service is scheduled.
Leaf removal?
Leaves are mulched and gradually removed unless full cleanup is requested.

We've used D's Lawncare for starting our 3rd year now. He and his crew always do a great job. We have dogs and they're always great about making sure the gate is secure when done with the backyard so we don't have any escapees the next time they're let out. He's great about setting up a schedule for service and only deviating due to rain/bad weather.
Couldn't ask for a better lawncare. They were professional and on time. Other lawncare places were not available, many places were unreachable, but not Ds. I'm deployed and the wife didn't restart our lawn services after winter broke. D's lawn care was able to come out and get a handle on things immediately after we contacted them, great work and easy to communicate with, highly recommended.

I contacted Ds Lawn service the day before hoping that they were able to do bulk removal and they were. He was very timely with the responses. He was on time and did an overall great job.
Contacted D's lawncare in the morning, he came and gave me a great quote and took care of my lawn on the spot. Cleaned up after himself and is taking a lot of stress off me for the summer of having to worry about lawn work. Highly recommend!!!
